1. About NEAREE
NEAREE is a dating service designed to help adults discover compatible people nearby, communicate with matches and arrange real-world meetings.
NEAREE is not a guarantee that a member will receive matches, replies, dates, relationships or any particular outcome.
2. Eligibility
You may use NEAREE only if:
- you meet the minimum age displayed by NEAREE and applicable law;
- you can legally enter into a binding contract;
- the information you provide is accurate enough for the service;
- you are not prohibited from using the service under applicable law;
- you are not using NEAREE on behalf of another person without authorisation.
NEAREE is intended for adults. The app's age gate applies the configured minimum age.
You may not create an account after your account has been banned unless NEAREE expressly authorises you to do so.
3. Account
You are responsible for:
- keeping your account secure;
- keeping authentication methods under your control;
- providing truthful information;
- not sharing your account;
- promptly reporting unauthorised access.
You may sign in using supported identity providers or e-mail verification.
We may suspend or restrict an account where necessary for safety, fraud prevention, legal compliance or violation of these Terms.
4. Dating profile
You control the information you publish in your dating profile.
You must not publish:
- false identity information intended to deceive;
- another person's photos without permission;
- content that impersonates another person;
- personal data of another person without a lawful basis;
- advertising or spam;
- external contact details where prohibited by product safety rules;
- illegal or harmful content.
Profile information must remain reasonably accurate.
5. Photos and verification
You may upload photos that you own or have permission to use.
NEAREE may remove photos that violate these Terms, safety rules or applicable law.
Where photo verification is available, you agree to follow the verification instructions honestly.
Verification is a safety signal, not a guarantee that a member is safe, truthful or suitable.
6. Likes, matches and discovery
NEAREE uses product rules to determine which profiles may be shown to you.
A match occurs when the applicable mutual-interest conditions are met.
NEAREE may limit, change or remove discovery eligibility for safety, quality, inactivity or technical reasons.
The service is designed to avoid an endless swipe feed. Daily and category discovery limits may apply.
7. Location and Nearby
If you grant location permission, NEAREE may use foreground location to provide discovery and Nearby functionality.
NEAREE does not intentionally expose another member's exact location through the service.
The Nearby feature uses privacy-protected aggregates.
The optional “I'm Out” feature is time-limited and does not publish your exact location.
You are responsible for deciding whether and where to meet another person.
8. Chat
Chat is intended for communication between eligible matches.
You must not use chat to:
- threaten or harass;
- stalk;
- scam;
- extort;
- distribute malware;
- distribute illegal content;
- send unsolicited commercial spam;
- exploit or target minors;
- impersonate another person;
- distribute another person's private information without lawful authority.
Messages may be retained according to the Privacy Policy and may be reviewed by authorised moderators where required by a valid safety process.
NEAREE does not guarantee delivery, permanence or recovery of every message.
9. Date planning
NEAREE may provide tools to propose and plan dates.
NEAREE does not guarantee the accuracy, safety, opening hours, availability or suitability of any suggested venue or place.
You remain responsible for independently evaluating the place and circumstances of a meeting.
The “We Met” feature is private feedback and should not be treated as proof of a real-world event.
10. Safety
NEAREE provides safety tools including:
- block;
- report;
- verification;
- safety guidance;
- date-sharing assistance;
- moderation.
These tools reduce risk but cannot eliminate it.
You should never send money to someone solely because you met them through NEAREE.
Do not disclose sensitive financial credentials or security codes to another member.
If you feel unsafe, leave the situation and contact appropriate local emergency or support services.
11. User content
You retain ownership of content you upload, subject to rights held by third parties.
You grant NEAREE a limited, non-exclusive, worldwide, royalty-free licence to host, reproduce, process, resize, technically transform, transmit and display your content solely as necessary to:
- operate the service;
- show your profile to eligible members;
- deliver messages and media;
- moderate content;
- provide backups and security;
- improve reliability.
The licence ends when the content is deleted, except for copies that must temporarily remain for legal, security, backup or dispute purposes.
NEAREE does not acquire ownership of your photos, biography or messages.
12. Prohibited conduct
You must not:
- use NEAREE for illegal purposes;
- create fake identities for deception or fraud;
- harass, threaten or stalk another person;
- target minors;
- solicit sexual exploitation or trafficking;
- distribute intimate images without consent;
- publish private information without lawful authority;
- use bots or scraping tools;
- reverse engineer or attack the service;
- bypass rate limits or safety controls;
- manipulate matches or recommendations through technical abuse;
- send spam or unsolicited commercial messages;
- sell or transfer your account;
- attempt to obtain another user's credentials;
- upload malware;
- circumvent a suspension or ban;
- use the service to collect data about members for another database or commercial purpose.
13. Reporting and moderation
You can report another member through the app where the reporting context is available.
NEAREE may:
- warn;
- restrict;
- hide;
- suspend;
- ban;
- remove content;
- disable features;
- preserve evidence where legally justified.
Automated signals may help identify suspicious behaviour. Human review may be used for moderation decisions where appropriate.
A moderation decision does not necessarily mean that NEAREE has determined criminal liability.
14. Digital Services Act procedures
Where the Digital Services Act applies, NEAREE will maintain appropriate mechanisms for:
- reporting illegal content;
- reporting violations of the Terms;
- receiving reasons for relevant restriction decisions;
- internal complaint handling where required;
- cooperation with competent authorities.
The final publication must include the operator's current DSA contact details:
[DSA CONTACT EMAIL]
and any additional legal representative/contact information required for the applicable establishment structure.
15. NEAREE+
NEAREE may offer a paid subscription called NEAREE+.
Depending on the current product configuration, NEAREE+ may include:
- enhanced discovery controls;
- expanded compatibility explanations;
- wider Nearby functionality;
- expanded date planning;
- other premium features listed in the app.
The exact benefits and prices shown at the time of purchase apply to the relevant purchase.
A subscription purchased through Apple or Google is governed by the applicable store's billing and subscription mechanisms.
A subscription purchased on the NEAREE web application may be processed by Stripe.
16. Coins
NEAREE may offer virtual coins.
Coins may be:
- purchased;
- earned through eligible product actions;
- spent on configured features such as highlighted likes or chat unlocking.
Coins are not money and cannot normally be redeemed for cash.
The current product design does not make coins expire.
The balance and transactions are maintained in a ledger.
The exact price and what a coin feature costs are displayed before purchase.
Refunds may be handled differently depending on whether the purchase was made through Apple, Google or Stripe.
17. Payments
Apple / Google
Purchases made in native iOS or Android applications may be processed through the applicable app store.
The store's terms and payment rules also apply.
Stripe
Web subscriptions and applicable web coin purchases may use Stripe Checkout.
NEAREE does not receive your full card number from Stripe Checkout.
Stripe may issue invoices and process payment information according to its own terms.
18. Consumer cancellation rights
If you are a consumer in a jurisdiction that provides a statutory withdrawal or cancellation right, those rights apply unless a lawful exception applies.
For digital services or digital content, the applicable law may allow the right of withdrawal to be limited or lost after the service starts, where the required express consent and acknowledgement have been obtained.
The checkout flow must contain the notices and confirmations required by the applicable consumer law.
Nothing in these Terms removes mandatory consumer rights.
19. Price changes
NEAREE may change prices for future purchases or renewal periods.
Where the law requires advance notice or a renewed consent, NEAREE will provide it.
A price change does not retroactively change a completed purchase.
20. Intellectual property
NEAREE and its licensors own the service's software, trademarks, visual design, documentation and other protected materials, except for third-party material and user content.
You may use the service only for its intended purpose.
You may not copy, modify, distribute, sell or reverse engineer NEAREE except where applicable law expressly permits it.
21. Third-party services
NEAREE integrates with third parties such as:
- Apple;
- Google;
- Stripe;
- hosting providers;
- object storage;
- notification providers;
- map/tile providers.
Third-party services may have their own terms and privacy policies.
NEAREE is not responsible for independent services outside its control.
22. Availability
We aim to keep NEAREE available and reliable, but we do not guarantee:
- uninterrupted availability;
- error-free operation;
- permanent message storage;
- uninterrupted notifications;
- availability of a particular venue;
- uninterrupted third-party services.
Maintenance, security incidents and provider outages may temporarily affect the service.
23. Account suspension and termination
We may suspend or terminate an account where reasonably necessary because of:
- serious or repeated Terms violations;
- safety risk;
- fraud;
- illegal activity;
- abuse of other members;
- security threats;
- legal obligations.
Where appropriate, we will explain the decision and provide the applicable complaint or appeal mechanism.
You may stop using NEAREE at any time and request account deletion.
24. Effect of deletion
Deleting an account removes or anonymises dating data as described in the Privacy Policy.
Some records may remain where required for:
- legal obligations;
- fraud prevention;
- safety;
- dispute resolution;
- accounting;
- enforcement of prior restrictions.
This does not mean that the deleted profile remains publicly visible.
25. No guarantee of relationship outcomes
NEAREE is a service for introductions and communication.
We do not guarantee:
- a match;
- a reply;
- a date;
- a relationship;
- another member's identity;
- another member's intentions;
- another member's behaviour;
- the safety of an offline meeting.
Use appropriate caution.
26. Liability
To the maximum extent permitted by applicable law, NEAREE is not liable for indirect or consequential losses arising from your use of the service.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer rights, liability for death or personal injury caused by negligence where applicable, or other non-excludable statutory liability.
The final liability section must be reviewed for the operator's applicable jurisdiction and B2C consumer law.
27. Indemnity
To the extent permitted by applicable law, you are responsible for losses directly caused by your unlawful use of NEAREE, fraud, intentional misuse or material violation of these Terms.
This section does not override mandatory consumer protections.
28. Governing law and disputes
The final version must specify the operator's chosen governing law and jurisdiction after legal review.
For EU consumers, mandatory protections of the consumer's country of residence remain applicable where required by law.
Proposed operator law: Hungarian law.
Competent courts: [TO BE CONFIRMED BY COUNSEL].
29. Changes to these Terms
We may update these Terms when:
- the service changes;
- new features are introduced;
- pricing models change;
- safety rules change;
- legal requirements change.
For material changes, we will provide notice and obtain renewed acceptance where required.
The current version and effective date are displayed at the top.
